Terms of use

The rules for using scalewell.app. By using the site you agree to them; if you do not, please do not use it.

1. Who we are

The site is operated by Hyperscaling Solutions Inc. (“Scalewell”, “we”, “us”), a Delaware corporation, 131 Continental Dr, Suite 305, Newark, Delaware 19713, USA. Contact: hello@scalewell.app.

2. Who may use the site

The site is for businesses. You must be at least 18, and if you submit information for a company, you confirm you are authorised to do so on its behalf.

3. Information, not an offer

Everything on the site — descriptions of the product, fee ranges, advance rates, timelines and examples — is general information. It is not an offer or commitment to provide financing, an offer of securities, or financial, investment, legal, tax or accounting advice. Financing is available only to eligible businesses, after our review, under a separate written agreement. If that agreement differs from anything on the site, the agreement governs.

4. Calculator and estimates

The calculator and growth charts run a simplified, illustrative model on the numbers you enter. They are not forecasts, and actual results, amounts and fees depend on your cohort performance and our review. Do not rely on them as the sole basis for a business decision.

5. What you send us

Information you submit should be accurate and yours to share. You allow us to use it to respond to you and to assess your eligibility, as described in our privacy policy. Please do not send account credentials or confidential documents through site forms; we will ask for what we need through a secure channel.

6. Acceptable use

Do not use the site unlawfully; scrape or harvest it by automated means; probe, interfere with or overload it; introduce malicious code; impersonate anyone; or submit false information to obtain financing.

7. Our content

The site, its text, design, calculator and the Scalewell name and mark belong to us or our licensors. You may view and share the site for your own business evaluation; any other copying, modification or commercial use needs our written permission.

8. Other sites and services

Links to third-party services — including TidyCal, Substack and Campaignswell — are provided for convenience. Their own terms and privacy policies apply, and we are not responsible for them.

9. Disclaimers

The site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise the site will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site. Our total liability for any claim relating to the site is limited to US$100. Nothing here limits liability that cannot be limited by law.

11. Indemnity

You agree to cover our reasonable losses and costs arising from your breach of these terms or your misuse of the site.

12. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute relating to the site will be heard exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

13. General

We may update these terms by posting a new version here with a new effective date; continuing to use the site means you accept it. We may suspend or restrict access to the site at any time. If any provision is unenforceable, the rest remain in effect. Not enforcing a provision is not a waiver. These terms, with the privacy policy, are the entire agreement between you and us about the site.
